[[ bracketed ]] placeholder, before publishing.These Terms & Conditions ("Terms") govern your access to and use of the Aura Anesthesia website, web application, and free readiness diagnostic (the "Service"), operated by Happy Sleepy Time Anesthesia LLC ("Aura," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for nurse anesthesia students, residents, and professionals preparing for certification.
2. Your account
You are responsible for the information you provide, for keeping your login credentials secure, and for all activity under your account. Notify us promptly of any unauthorized use. Accounts are for a single individual and may not be shared.
3. Educational use only — not medical or professional advice
Aura is a study aid. All questions, rationales, tutor responses, flashcards, and other content are provided for educational purposes to help you prepare for examinations. They are not medical, clinical, diagnostic, or professional advice, and must never be used to make decisions about the care of any real patient. Always rely on your training, supervising clinicians, and authoritative sources for clinical decisions.
4. AI-generated content
Parts of the Service use artificial intelligence to generate and process content. AI output can be inaccurate, incomplete, or out of date, even when it cites a source. While we take steps to ground and audit content, you are responsible for verifying anything you rely on against authoritative references. We do not warrant that any content is accurate, complete, or current.
5. No guarantee of exam results
We do not guarantee any particular outcome, including that you will pass the NCE, SEE, or any other examination, or achieve any score. Your results depend on many factors outside our control. Any readiness score, projection, or similar figure is an estimate for study guidance only and is not a prediction or promise of results.
6. Your content and the rights you grant us
You retain ownership of the materials you upload or create ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and adapt Your Content solely to operate and provide the Service to you — including transmitting it to the service providers described in our Privacy Policy. You represent and warrant that:
- you own Your Content or have the necessary rights and permissions to upload and use it, including any third-party or institutional course materials; and
- Your Content does not contain patient-identifiable information, protected health information, or anything unlawful.
Improving the Service and our AI. You agree that we may use de-identified or aggregated information derived from your interactions with the Service — such as the questions you ask, the answers you give, your performance data, and the content the Service generates for you — to analyze, improve, and develop the Service, including training and refining our own AI-powered features. For this purpose we do not use information that identifies you, and we do not use your uploaded materials as verbatim training data. We do not sell your personal information, and we do not provide Your Content to third parties to train their own general-purpose AI models except as needed to provide the Service (see our Privacy Policy). You can opt out of this improvement use at any time in your account settings, or by emailing auraanesthesiasupport@gmail.com; opting out does not affect the core features available to you.
7. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in violation of these Terms;
- upload patient data/PHI, malware, or content you do not have the right to use;
- copy, scrape, resell, sublicense, or redistribute the question bank, rationales, or other Aura content;
- reverse engineer, probe, or attempt to bypass the Service's security or usage limits; or
- use Service outputs to make real patient-care decisions.
8. Our intellectual property
The Service and all content we provide — including the question bank, rationales, software, design, and trademarks — are owned by Aura or our licensors and are protected by law. We grant you a limited, personal, non-transferable, revocable license to use the Service for your own exam preparation. No other rights are granted.
9. Beta service and changes
The Service is provided on an evolving, pre-release ("beta") basis. We may add, change, suspend, or remove features at any time. We may also impose or change usage limits.
10. Fees and subscriptions
Access is currently free during our beta period. If we introduce paid plans, the price, billing period, renewal, and cancellation terms will be presented to you before you purchase, and additional payment terms will apply at that time. 11. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. 12. Disclaimers
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT CONTENT WILL BE ACCURATE OR COMPLETE.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AURA AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR EXAM OUTCOMES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless Aura from claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.
15. Governing law and disputes
